This is an English translation of the original Privacy Policy published in Spanish. In the event of any discrepancy between the two versions, the Spanish version shall prevail.

I. Data Controller

This Privacy Policy describes how Asociación SAPIENS.LAT, a Peruvian nonprofit association identified with Taxpayer ID (RUC) No. 20612449415, hereinafter “Sapiens,” collects, uses, protects, and shares the personal data of individuals who interact with the donations section of this website (hereinafter, the “Site”), hereinafter also the “Donor(s).” This policy complements our Terms and Conditions for Donations and should be read together with them.

II. Personal Data We Collect

Through the Site, Sapiens may collect:

Identification and contact data: name and email address, needed to confirm the donation and issue the corresponding receipt.
Donation data: amount, type (one-time or monthly), and date of the contribution.
Basic technical data: information the browser automatically sends when visiting the Site, such as IP address or browser type.

Sapiens does not collect or store credit or debit card data. That information is processed directly by Culqi, our payment gateway, under its own security protocols.

III. Purpose of Processing

Personal data is used to:

Process the donation and issue the corresponding confirmation and receipt.
Comply with applicable legal and tax obligations, including those arising from Sapiens’ status as a Qualified Donation-Receiving Entity before SUNAT.
Prevent fraud and comply with applicable anti-money laundering and counter-terrorism financing regulations.
Keep the Donor informed about Sapiens’ work, unless the Donor indicates otherwise.

IV. Legal Basis

The processing of personal data is based on the consent given by the Donor at the time of donating, on Sapiens’ compliance with applicable legal obligations, and on the legitimate interest in preventing fraud, in accordance with Peru’s Law No. 29733, Personal Data Protection Law, and its Regulations (Supreme Decree No. 016-2024-JUS).

V. Data Retention

Sapiens retains personal data for as long as necessary to fulfill the purposes described in this policy and any applicable legal obligations, including tax-related ones. Once that period has elapsed, the data is securely deleted or anonymized.

VI. Who We Share Data With

Sapiens does not sell or rent personal data to third parties for commercial or advertising purposes. Personal data may only be shared with:

Culqi, to process the donation payment.
Technology providers that support the operation of the Site (for example, web hosting or email services), subject to confidentiality obligations.
Competent authorities, when required by law.

VII. International Data Transfers

Some of the technology providers that support the Site may process personal data outside of Peru. In such cases, Sapiens adopts the measures required under Law No. 29733 to ensure an adequate level of protection for the information.

VIII. Cookies and Similar Technologies

The Site may use cookies or similar technologies for technical purposes and basic usage analysis. These technologies are not used for advertising purposes or to build profiles for sale to third parties. The Donor may configure their browser to block or delete cookies; this may affect some of the Site’s functionality.

IX. Donor Rights (Data Subject Rights)

The Donor has the right to access, rectify, cancel, and object to the processing of their personal data, as well as to request information about how Sapiens uses it. These rights may be exercised by writing to contacto@sapiens.lat, indicating which right the Donor wishes to exercise. Sapiens will respond within the timeframes established by Law No. 29733 and its Regulations.

X. Information Security

Sapiens adopts reasonable technical and organizational measures to protect the personal data it directly manages. The Donor’s financial data is processed by Culqi under its own security and encryption protocols; Sapiens never has access to that information.

XI. Minors

The Site is not directed at minors. If a minor makes a donation, it must be authorized by their parent or legal guardian, in accordance with Peruvian law.

XII. Changes to This Policy

Sapiens may update this Privacy Policy at any time. Changes take effect upon publication in this same section, together with the corresponding “last updated” date.
